FSSAI applications rarely die dramatically; they stall — reverted for corrections nobody answers, filed in the wrong tier, or carrying premises papers that cannot survive scrutiny. The 2026 amendments added a new trap: the turnover thresholds moved on 1 April 2026, so files prepared on the old limits are landing in the wrong tier. Here is the failure map, the current tiers, and the cure for each branch.

The tiers from 1 April 2026

The Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026 raised the turnover limits with effect from 1 April 2026 and gave registrations and licences perpetual validity:

Turnover is only the first test. Certain activities, such as importers, units in specified locations and some manufacturing categories, need a State or Central licence whatever their turnover, which is why the KoB selection matters as much as the number. The government fee is charged per year and differs by tier and activity; take the current figure from the FoSCoS fee schedule at the time of filing rather than an old article.

Worked example: a Rs 2 crore bakery

A Thane bakery with Rs 2 crore of annual sales files for Basic Registration in May 2026, reasoning that "the limit went up to Rs 1.5 crore and we are close enough". The application is reverted with a remark that the declared turnover exceeds the registration limit.

The reverse happens too: a Rs 1.2 crore unit that files for a State Licence out of habit may be told Registration now suffices. Either way, the cost is time, so test the tier before paying anything.

Prevention checklist

  • Tier test on real turnover/activity before filing anything, using the 2026 limits
  • KoB selections read aloud against what you actually do
  • Premises papers chain-checked like a GST file
  • Technical annexures produced properly the first time
  • One owner for the portal login who checks it weekly and answers each revert within the time shown against the remark
  • After approval, diarise the annual fee and the Form D1 annual return, and use a licence modification rather than a fresh application when products or premises change

Frequently asked questions

How do I know why my application is stuck?

The FoSCoS status and remarks say more than applicants read — pull the exact remark text first; the cure is usually named inside it.

Reverted twice — can it still be saved?

Usually yes within windows; repeated reverts on the same defect mean the document, not the portal, is the problem. Fix the document properly once.

Does rejection bar me from reapplying?

No — a corrected fresh application is standard. What repeats badly is refiling identical defects; inspectors remember premises.

The inspector wants changes to my kitchen. Negotiable?

Hygiene/layout requirements track the regulations for your category — argue category applicability where genuinely wrong, otherwise the cheaper path is compliance and re-inspection.

Can I operate while the application is pending?

Operating without the applicable credential is a violation platforms and inspectors both catch — sequence launch with the certificate, not hope.

My consultant filed the wrong tier. Who fixes it?

Whoever files next — the cure is a correct-tier application with clean papers; the lesson is tier-testing before fees, whoever you use.

Are “approval guaranteed” agents real?

No one can guarantee a government approval — treat the claim as a warning label. Complete files and answered reverts are what actually move approvals.

What about the annual fee under perpetual validity?

Registrations and licences no longer need renewal, but the annual fee and the annual return (Form D1, where it applies) still do. Non-payment of the annual fee or non-filing of Form D1 can lead to suspension. Clear the default, then regularise through FoSCoS.

Which tier do I need after 1 April 2026?

On turnover alone: Registration up to Rs 1.5 crore, State licence above Rs 1.5 crore and up to Rs 50 crore, Central licence above Rs 50 crore. Some activities and locations need a State or Central licence regardless of turnover, so check your Kind of Business on FoSCoS before filing.

I already hold a State licence but my turnover is under Rs 1.5 crore. Must I switch?

Not automatically. A valid licence continues. Whether to move down to Registration is a choice to make with the annual fee and conditions in view; do not let the licence lapse into suspension while you decide.
